1. Acceptance of Terms

By accessing or using LangPass (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using the Service, you represent that you meet this age requirement.

2. Description of Service

LangPass is an AI-powered language learning platform that provides:

  • Practice questions for language proficiency exams (TOEFL, IELTS, TOEIC, JLPT, HSK, DELF/DALF, DELE, TOPIK).
  • AI-powered coaching, scoring, and feedback.
  • News-based language learning materials.
  • Vocabulary building tools.

3. Important Disclaimers

3.1 Not an Official Test Provider

LangPass is an independent service and is NOT endorsed by, affiliated with, or approved by any of the following organizations:

  • Educational Testing Service (ETS): TOEFL®, TOEIC®
  • British Council, IDP, Cambridge: IELTS™
  • Japan Foundation, JEES: JLPT
  • Hanban / Chinese Testing International: HSK
  • France Education International: DELF/DALF
  • Instituto Cervantes: DELE
  • National Institute for International Education: TOPIK

All test names and trademarks are the property of their respective owners and are used here solely for descriptive purposes.

3.2 AI-Generated Content

All practice questions, scoring, and feedback are generated by artificial intelligence. They are:

  • Not official test materials. Our questions are AI-generated practice materials inspired by public exam formats.
  • Not guaranteed to be accurate. AI scoring is an estimate and may differ from actual test scores.
  • For practice purposes only. Do not rely solely on our scores to predict official test results.

3.3 No Guarantee of Results

We do not guarantee that using LangPass will result in specific test scores or outcomes. Results depend on individual effort, study habits, and many other factors.

4. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete information when creating an account.
  • You must not share your account with others or create multiple accounts.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Billing

5.1 Free Tier

The free tier includes limited daily access (3 practice questions, 1 news article, 1 quiz per day). No payment is required.

5.2 Paid Subscriptions

  • Paid plans are billed monthly.
  • You are buying from Lee&J company Co., Ltd. (주식회사 리엔제이컴퍼니), business registration number 433-81-03870. We are the seller and your counterparty for the sale.
  • PayPal is our payment processor. It charges your payment method on our behalf; it is not a party to the sale and does not act as the seller.
  • We issue your receipt, and we determine, collect, and remit any applicable VAT, sales tax, or other transaction taxes.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • Prices are shown in USD and may be subject to taxes applicable where you live.

5.3 Credit Packs

  • Credit packs are a one-off purchase available on a paid plan; they do not renew.
  • Purchased credits do not expire and remain usable after a subscription ends, until you spend them.
  • Refunding a pack reclaims the credits it granted. Credits already spent cannot be reclaimed and the balance stops at zero.

5.4 Cancellation and Refunds

  • You may cancel your subscription at any time from the Settings page in your account. Cancelling stops future renewals.
  • After cancellation, you retain access until the end of the billing period you have already paid for.
  • Refunds are available within 14 days of the initial purchase or the most recent renewal if you have not substantially used the Service during that period. Email support@lang-pass.com to request one.
  • We process refunds ourselves and return the money to the original payment method. The payment processor does not decide refunds on our behalf.

6. Acceptable Use

You agree NOT to:

  • Use the Service to generate content that infringes intellectual property rights.
  • Attempt to reverse-engineer, decompile, or extract our AI prompts or algorithms.
  • Use automated tools (bots, scrapers) to access the Service.
  • Share or redistribute AI-generated practice materials commercially.
  • Impersonate another person or misrepresent your identity.
  • Use the Service for any illegal purpose.
  • Circumvent usage limits or subscription tier restrictions.

7. Intellectual Property

7.1 Our Content

The Service, including its design, code, AI models integration, and branding, is owned by LangPass. AI-generated practice questions are provided for your personal, non-commercial use only.

7.2 Your Content

You retain ownership of content you create (essays, speaking responses). By submitting content for AI scoring, you grant us a limited license to process it through our AI systems for the purpose of providing the Service.

7.3 News Content

News articles displayed in the Service are sourced from publicly available RSS feeds (VOA Learning English, NHK World, RFI, KBS World). Original articles remain the property of their respective publishers. We provide links to original sources.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by a recognized arbitration body, rather than in court. You agree to waive your right to a jury trial and to participate in class actions.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

For EU/EEA users: Nothing in this section limits your rights under mandatory consumer protection laws of your country of residence.

10. Termination

  • We may suspend or terminate your access if you violate these Terms.
  • You may delete your account at any time through Settings.
  • Upon termination, your right to use the Service ceases immediately.
  • Sections 3, 7, 8, and 9 survive termination.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.
